These Terms & Conditions govern your use of the Alice Absolutely website and your purchase of products or services from McCallister Ventures, LLC, which operates the Alice Absolutely and Alice Absolutely Studios brands.

By visiting this website, placing an order, joining the Florida Field Guide Society, submitting a form, or otherwise using our services, you agree to these Terms & Conditions.

For purposes of these Terms, “Alice Absolutely,” “we,” “us,” and “our” refer to McCallister Ventures, LLC and the Alice Absolutely and Alice Absolutely Studios brands.

1. Who May Use This Website

This website is intended for adults.

By placing an order, you represent that you are legally capable of entering into a binding contract or are making the purchase with the authorization and supervision of a parent or legal guardian.

Parents and guardians are responsible for supervising minors who access or make purchases through the website.

2. United States Sales Only

Alice Absolutely currently accepts and ships online orders only within the United States.

Orders requiring shipment outside the United States are not currently available through the website.

We may expand shipping territories in the future and may update these Terms if we do.

3. Products and Availability

Alice Absolutely offers a combination of:

Original artwork

Signature Prints

Open-edition Field Guide Proofs

Greeting cards

Apparel

Books

Florida Field Guide Society memberships

Preorder products

Other art, merchandise, or educational products

Some products are made, fulfilled, and shipped directly by Alice Absolutely.

Other products may be produced and fulfilled by third-party print-on-demand or shipping providers.

Availability may change without notice.

We reserve the right to discontinue, limit, or modify products at any time.

4. All Sales Are Final

All sales are final.

We do not accept returns, exchanges, or order cancellations except where required by applicable law or where an item arrives damaged or defective.

Please review your order carefully before completing checkout.

Because many Alice Absolutely products are made to order, produced in limited quantities, created specifically for a customer, or fulfilled immediately after purchase, we are unable to accommodate change-of-mind returns or exchanges.

5. Order Changes and Cancellations

Orders cannot be changed or canceled after they are placed.

This includes changes to:

Product selection

Size

Quantity

Shipping address

Customization

Subscription selection

Print-on-demand products may enter production shortly after an order is submitted.

Please confirm all order details before completing checkout.

6. Damaged or Defective Products

If your order arrives damaged or defective, you must contact us within 48 hours of delivery.

Your order number

A description of the issue

Clear photographs of the damaged or defective item

Clear photographs of the shipping box, mailer, packaging, and shipping label

This documentation is necessary because we may need to submit a claim to the shipping carrier, insurer, or fulfillment provider.

Failure to report damage within 48 hours or provide adequate documentation may limit our ability to replace the item or pursue a shipping claim.

Replacement, refund, or other resolution will be determined based on the circumstances, applicable carrier or fulfillment-provider policies, and applicable law.

7. Shipping Addresses

You are responsible for entering a complete and accurate shipping address at checkout.

Alice Absolutely is not responsible for delays, losses, or additional charges caused by an incorrect or incomplete address provided by the customer.

If a package is returned to us because of an incorrect address, reshipment may require payment of additional shipping charges.

8. Lost, Stolen, or Misdelivered Packages

Packages shipped directly by Alice Absolutely will generally be insured where commercially reasonable.

If a package is lost in transit, we may assist with or initiate a carrier claim as appropriate.

Customers agree to cooperate with any carrier or insurer investigation.

A package shown by the carrier as delivered to the shipping address provided by the customer is not automatically considered lost and does not automatically qualify for a refund or replacement.

Claims involving theft, misdelivery, or missing packages may be subject to carrier or insurance review.

9. Split Shipments

Alice Absolutely uses multiple fulfillment methods.

Some items may be made and shipped by third-party providers, while others are fulfilled directly by Alice Absolutely.

As a result:

Items from the same order may ship separately

Packages may arrive on different dates

Tracking information may be issued separately

This is normal and does not indicate that part of your order was omitted.

10. Print-on-Demand Products

Certain products, including apparel, open-edition Field Guide Proofs, greeting cards, and other merchandise, may be produced by a third-party print-on-demand provider such as Printify.

Production times, materials, print placement, color reproduction, and minor manufacturing variations may differ slightly between orders.

These ordinary production variations are not considered defects.

Where a genuine manufacturing defect occurs, we will work with the fulfillment provider to determine an appropriate resolution.

11. Handmade Artwork

Original Alice Absolutely artwork is made by hand.

The carved-paint process intentionally produces visible texture, tool marks, layered surfaces, edges, and slight irregularities.

These characteristics are part of the work and are not defects.

No two handmade works are identical.

12. Color and Screen Display

We make reasonable efforts to photograph and display artwork and merchandise accurately.

However, screens, monitors, phones, browsers, lighting conditions, and photography can affect how color and texture appear.

We cannot guarantee that the color or surface appearance displayed on your screen will perfectly match the physical item.

This is particularly true of layered, carved, textured, metallic, or highly dimensional artwork.

13. Signature Prints and Limited Editions

Certain Alice Absolutely works may be sold as limited-edition Signature Prints.

When a product is identified as a limited edition, the stated edition size is fixed for that specific version, size, or format.

Once the edition is sold out, we will not produce additional copies within that stated edition.

Artist proofs, partner proofs, or other specifically identified proofs may exist outside the numbered public edition where disclosed.

14. Certificates of Authenticity

Original artwork and certain limited-edition works may include a Certificate of Authenticity.

Replacement certificates may be issued at our discretion and may require reasonable proof of ownership or provenance.

We are not obligated to replace lost, damaged, altered, or separated certificates.

15. Ownership of Artwork and Copyright

Purchasing an artwork, print, photograph, product, or other physical object gives you ownership of the physical item only.

It does not transfer copyright, reproduction rights, licensing rights, trademark rights, merchandising rights, or other intellectual-property rights.

Unless expressly transferred in a separate written agreement, all copyrights and reproduction rights remain with McCallister Ventures, LLC and/or Alice Absolutely.

You may display purchased artwork privately and may share ordinary photographs of the artwork for personal, noncommercial purposes.

You may not, without written permission:

Reproduce the artwork

Create prints or copies

Use the artwork in commercial advertising

Manufacture merchandise using the artwork

Create derivative commercial products

License the artwork

Mint or create NFTs from the artwork

Use the artwork to train, market, or commercialize artificial-intelligence products

Use the artwork in any commercial publication or campaign

Present yourself as the creator, licensor, or authorized representative of the artwork

16. Resale

You may resell a physical artwork or print that you lawfully own.

However, resale does not transfer copyright or reproduction rights.

You may not falsely state or imply that Alice Absolutely:

Endorsed the resale

Authenticated the item

Verified provenance

Set the resale price

Participated in the transaction

unless we have expressly done so in writing.

17. Florida Field Guide Society

The Florida Field Guide Society is a recurring subscription program.

Members are billed monthly at the price displayed at the time of enrollment.

Membership currently includes two 5x7 Field Guide Proofs mailed each month, together with any additional benefits or materials described on the membership page.

Members who join during a month will begin with the next scheduled monthly shipment unless otherwise stated.

18. Society Billing and Cancellation

Florida Field Guide Society memberships renew automatically each month until canceled.

You may cancel before your next billing date to prevent the next recurring charge.

Once a monthly membership charge has been processed, it is nonrefundable except where required by law.

We do not provide prorated refunds for partial months.

Cancellation affects future billing and does not reverse charges already processed.

19. Society Benefits and Pricing

We may change future membership pricing or optional member benefits from time to time.

Where appropriate, we will provide advance notice of material changes.

Promotional benefits, discounts, special offers, member pricing, gifts, or other perks may be modified, replaced, or discontinued.

The core membership deliverable is the monthly shipment described on the current Society membership page.

20. Preorders

We may occasionally offer products for preorder.

Any listed release, production, or shipping date is an estimate unless expressly stated otherwise.

Preorder schedules can be affected by production delays, supplier delays, printing issues, carrier disruptions, or other circumstances beyond our reasonable control.

By purchasing a preorder, you agree that reasonable delays may occur.

If we are unable to fulfill an order within the timeframe required by applicable law, we will provide any notice, consent option, refund, or other remedy required by law.

21. Prices, Errors, and Inventory

We may change prices at any time.

We reserve the right to correct:

Pricing errors

Product-description errors

Inventory errors

Typographical errors

Promotional errors

Technical errors

If a product is mistakenly listed at an incorrect price or sold when unavailable, we may cancel the affected order and issue a refund.

An obvious pricing mistake does not obligate us to sell a product at the incorrect price.

22. Refusal or Cancellation of Orders

We reserve the right to refuse, limit, or cancel an order when reasonably necessary.

This may include orders that:

Appear fraudulent

Contain obvious pricing errors

Exceed available inventory

Appear intended for unauthorized resale

Involve suspected misuse of discounts

Violate these Terms

Cannot be fulfilled

If we cancel a paid order that has not been fulfilled, we will refund the amount charged for the canceled item unless otherwise permitted by law.

23. Wholesale and Unauthorized Resale

Products purchased through the retail website are intended for personal use unless we expressly approve a wholesale, retailer, gallery, licensing, or reseller arrangement.

We reserve the right to refuse or cancel orders that appear to be placed for unauthorized bulk resale or commercial distribution.

Wholesale and licensing arrangements require separate written agreements.

24. Commissions

Custom commissions are governed by separate written agreements.

Those agreements may address:

Deposits

Payment schedules

Approvals

Revisions

Deadlines

Delivery

Cancellation

Copyright

Usage rights

If commission terms conflict with these website Terms, the separate signed commission agreement will control for that commission.

25. Educational and Field Guide Information

Information provided through the Florida Field Guide Project, website, product materials, field notes, blog posts, events, or educational content is provided for general informational and educational purposes.

It is not a substitute for professional:

Scientific advice

Wildlife-management advice

Veterinary advice

Medical advice

Legal advice

Land-management advice

Safety advice

We make reasonable efforts to provide accurate information but do not guarantee that any educational content is complete, current, or suitable for every purpose.

26. References to Partners, Researchers, and Organizations

Our website may reference conservation organizations, universities, scientists, researchers, media outlets, sponsors, collaborators, or other third parties.

A reference to an organization or individual does not automatically mean that person or organization:

Endorses Alice Absolutely

Endorses every product

Sponsors every project

Approves every statement made on the website

Specific partnerships or collaborations will be described as such where appropriate.

27. Third-Party Services and Links

Our website may contain links to or rely on third-party services, including payment processors, fulfillment providers, shipping carriers, embedded media, social networks, analytics services, and other platforms.

We are not responsible for the content, availability, security, policies, or practices of third-party websites or services.

Your use of third-party services may be subject to their own terms and policies.

28. Unsolicited Ideas and Submissions

We welcome enthusiasm for Florida wildlife, art, and the Florida Field Guide Project.

However, unsolicited suggestions, ideas, concepts, species requests, creative proposals, artwork ideas, or other submissions do not create:

A confidential relationship

A fiduciary relationship

An obligation to compensate you

An obligation to use the submission

An agreement that we will not independently develop similar ideas

Please do not send confidential or proprietary information unless we have agreed in writing to receive it on that basis.

29. Website Content and Intellectual Property

Unless otherwise stated, the website and its contents are owned by or licensed to McCallister Ventures, LLC.

This includes:

Artwork

Photographs

Graphics

Logos

Written content

Field Guide entries

Product descriptions

Website design

Videos

Illustrations

Branding

Downloadable materials

You may not reproduce, distribute, republish, sell, scrape, copy, modify, or commercially exploit website content without written permission.

30. Prohibited Uses

You may not use the website or services to:

Violate any law

Commit fraud

Infringe intellectual-property rights

Attempt unauthorized access

Introduce malware or harmful code

Scrape or harvest data

Interfere with website security

Misrepresent your identity

Abuse payment systems

Engage in unauthorized resale

Every feature will always be available

Third-party services will operate without interruption

Product photography will perfectly reproduce physical color or texture

Educational information will be error-free or complete

32. Limitation of Liability

To the fullest extent permitted by law, McCallister Ventures, LLC, Alice Absolutely, and their owners, employees, contractors, agents, and affiliates will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from your use of the website or purchase of products.

Where liability cannot legally be excluded, our liability will be limited to the maximum extent permitted by law.

Nothing in these Terms limits liability that cannot legally be limited or excluded.

33. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless McCallister Ventures, LLC, Alice Absolutely, and their officers, owners, employees, contractors, and agents from claims, damages, liabilities, and reasonable expenses arising from:

Your violation of these Terms

Your unlawful use of the website

Your infringement of another person’s rights

Your misuse of purchased content or intellectual property

34. Force Majeure

We are not responsible for delays or failures caused by circumstances beyond our reasonable control.

These may include:

Hurricanes

Tropical storms

Flooding

Wildfires

Severe weather

Natural disasters

Carrier interruptions

Postal disruptions

Labor disputes

Supply shortages

Production-provider failures

Internet outages

Payment-processing outages

Government actions

Public emergencies

Power outages

Other events beyond our reasonable control

We will make reasonable efforts to communicate significant delays and fulfill obligations when circumstances allow.

35. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where federal law controls.

To the extent permitted by law, legal proceedings relating to these Terms or transactions with Alice Absolutely will be brought in the state or federal courts serving Polk County, Florida.

36. No Waiver

If we do not immediately enforce a provision of these Terms, that does not waive our right to enforce it later.

37. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

38. Entire Agreement

These Terms, together with our Privacy Policy and any additional written terms applicable to a particular product, subscription, commission, promotion, or service, constitute the agreement between you and McCallister Ventures, LLC concerning your use of this website and related services.

39. Changes to These Terms

We may update these Terms from time to time to reflect changes in our products, services, business practices, technology, or legal obligations.

The updated effective date will appear at the top of this page.

Changes apply prospectively unless applicable law requires otherwise.
